Privacy Policy

1. Overview
This Privacy Policy explains what information Proffer Creative ("Service," "we," "us"), a product of Tekmerion Productions, collects from production companies and freelancers who use the Service ("Users," "you") and from your clients who receive or sign proposals through the Service ("Clients"), and how that information is used and shared.
2. Information We Collect
- Account information: your name, email address, company name, and password (stored securely by our authentication provider, not in plain text).
- Billing information: handled directly by our payment processor, Stripe. We receive limited billing metadata, such as your plan and subscription status — we do not receive or store your full card number.
- Content you provide: branding assets (such as your logo and colors), custom service rates, proposal and budget line items, and other material you enter into the Service.
- Client information: names, email addresses, project details, and electronic signatures that you or your Clients submit through your branded intake form or proposal.
- Usage data: basic technical information such as IP address, browser type, and activity logs generated by normal use of the Service.
- Cookies: session and authentication cookies necessary for you and your Clients to sign in and use the Service normally.
3. How We Use Information
- To operate, maintain, and improve the Service;
- To process subscription billing;
- To send transactional emails, such as proposal delivery and signature confirmations;
- To respond to support requests; and
- To comply with legal obligations.
4. How We Share Information
We do not sell your information or your Clients' information. We share information only with service providers who help us operate the Service, currently:
- Stripe — payment processing
- Supabase — database, authentication, and storage of account and Content data
- Netlify — application hosting
- EmailJS — transactional email delivery
Each provider receives only the data needed to perform its function. We may also disclose information if required by law, or to protect the rights, property, or safety of Tekmerion Productions, our Users, or others.
5. Data About Your Clients
When you submit Client information into the Service, or your Clients submit it directly through your branded intake form, we process that data on your behalf, solely to provide the Service to you. You are responsible for ensuring you have the right to collect and submit your Clients' personal information, and for your own compliance with any privacy laws that apply to your business.
6. Data Retention
We retain your account and Content data for as long as your account is active. If you cancel your account, we retain data for a limited period afterward to allow reactivation and to meet legal or accounting obligations, after which it is deleted or anonymized. You may request earlier deletion by contacting us at the address below, subject to any legal retention requirements. See Section 7 for how we respond to and notify you of a data security incident.
7. Data Security
We use reasonable administrative, technical, and organizational safeguards — such as encrypted connections and access controls — to protect information handled by the Service. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
If we become aware of a security breach that compromises the confidentiality, integrity, or availability of your personal information in a manner that creates a substantial risk of harm, we will notify affected individuals without unreasonable delay and in accordance with applicable law, including the Tennessee Identity Theft Deterrence Act (Tenn. Code Ann. § 47-18-2107). Notice will be sent to the email address associated with your account, or by another method reasonably calculated to reach you, and will describe the nature of the incident and the steps we are taking in response.
8. Your Rights and Choices
You may access, correct, or request deletion of your account information by contacting us. Depending on where you live, state privacy laws may give you additional rights regarding your personal information. 9. Children's Privacy
The Service is intended for business use by adults and is not directed to children under 13. We do not knowingly collect personal information from children.
10. International Users
The Service is hosted in the United States. If you access it from outside the U.S., your information will be transferred to and processed in the U.S.
11. Changes to This Policy
We may update this Privacy Policy from time to time. We will communicate material changes by email or through a notice within the Service.
